Terms of service

These terms are an agreement between you and Tend. By creating an account or using the service you agree to them. Please read them carefully — they explain what you can expect from us and what we expect from you.

1. Who we are

Tend (“Tend”, “we”, “us”) provides software that helps cleaning businesses manage jobs, clients, scheduling, estimates, invoices and crew. The service is provided from Cork, Ireland. These terms are governed by the laws of Ireland.

2. Your account

You must provide accurate information when you sign up and keep your login credentials secure. You are responsible for all activity that happens under your account, including the actions of teammates you invite. You must be at least 18 and authorised to enter into this agreement on behalf of your business.

The first person to register a business is its owner. Owners can invite admins and cleaners, set their permissions, and remove them at any time.

3. Acceptable use

You agree not to:

  • Use Tend for anything unlawful, or to store unlawful content;
  • Send messages or invoices that are deceptive, harassing or unsolicited spam;
  • Attempt to access another organisation's data, or probe, scan or breach our security;
  • Reverse engineer, resell or sublicense the service except as permitted by law;
  • Upload malware, or interfere with the operation of the service for others.

You are responsible for the content you put into Tend — client details, photos, invoices and messages — and for having a lawful basis to process it (see our Privacy policy).

4. Your data and content

You own your data. Granting us the rights we need to run the service (to host, process, back up and display your content to you and the customers you choose to send documents to) does not transfer ownership. You can export or delete your data, and we delete it on request or after account closure as described in our Privacy policy.

When you send an estimate or invoice to one of your customers, you are the controller of that customer's personal data and Tend acts as your processor. Documents you send carry your branding with a discreet “Powered by Tend” notice.

5. Fees and billing

During our beta, Tend is offered free of charge on the Founder plan. We will give you reasonable notice before any paid plan begins, and Founder accounts will keep a permanent loyalty discount. You will never be charged without first agreeing to a paid plan. Any card-payment features for your own customers' invoices are optional and clearly marked.

6. Service availability

We work hard to keep Tend available and fast, but we provide the service on an “as is” and “as available” basis during beta. We may update, change or temporarily suspend features to maintain and improve the service. We aim to give advance notice of planned maintenance where practical.

7. Third-party services

Tend integrates with services you choose to connect, such as email and messaging providers and file storage. Your use of those services is subject to their own terms. We are not responsible for third-party services, but we will tell you what data we share with them.

8. Liability

To the fullest extent permitted by law, Tend is not liable for indirect or consequential loss, lost profits, or loss of data beyond what is required to be restored from our backups. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. During the free beta, our aggregate liability is limited to the greater of the fees you have paid (which may be nil) or €100.

9. Suspension and termination

You can stop using Tend and close your account at any time. We may suspend or close an account that breaches these terms, poses a security risk, or is used unlawfully. Where we can, we will give you notice and a chance to put things right first. On closure you can export your data for a reasonable period before it is deleted.

10. Changes to these terms

We may update these terms as the product evolves. If we make a material change we will notify you by email or in the app before it takes effect. Continuing to use Tend after a change means you accept the updated terms.
